"Ecom Bazaar" manages the website www.bazaarier.com (the "Site"). "Ecom Bazaar Turkey" is our country of residence, and we stipulate that the governing law is local law. Any purchase, dispute, or claim arising out of or related to this Site shall be governed by and construed in accordance with the laws of Turkey. Visa or Mastercard debit and credit cards are accepted for payment in US Dollars. The price and currency displayed on the checkout page are the same as the price and currency printed on the transaction receipt, and the amount paid will appear on the card in your card's currency. We will not deal with or provide any services to the Office of Foreign Assets Control (OFAC) or sanctioned countries. Customers using the website who are under the age of 18 are not permitted to register as users of the Site, and are not permitted to make any transactions on or use it. The cardholder must keep a copy of the transaction records and the policies and rules of www.bazaarier.com. The user is responsible for maintaining the confidentiality of their account. All users are deemed to have read and agreed to the Merchant Agreement they joined upon completion of the membership process.
The website is a virtual sales contract between the customer and the consumer.
This contract is subject to the Consumer Protection Law No. 4077 regarding the sale and delivery of the product sold by the seller to the buyer. The scope and extent of the rights and obligations of the parties are governed by the provisions of the Regulation on the Principles and Procedures for the Implementation of Distance Sales Agreements.
Seller Information Ecom Bazaar
Recipient Information All Members: Ecom Bazaar E-Commerce Store is all buying members of the website (hereinafter referred to as the Buyer or Customer).
Resources and Products Information: Goods/Services or Product; type, quantity, brand/model, color, sale value, and payment sequence are as stated on the Site, and these promises may be changed without notifying the Buyer.
General Provisions
5.1 - The Buyer acknowledges that they have reviewed all preliminary information regarding the basic characteristics of the contract, the sale price, the payment method, and the delivery, mentioned in Article 4, and provides the necessary confirmation electronically. 5.2 - The contracted product must be delivered to the recipient or to the designated recipient within the period specified in the preliminary information, depending on the distance of the recipient's place of purchase for each product, with a statutory suspension period of 30 days. 5.3 - In case the contracted product is delivered to a person or entity other than the Buyer, the Seller assumes no responsibility as the person or entity requested for delivery does not accept the delivery. 5.4 - The Seller is responsible for delivering the contracted product in good condition, complete, conforming to the specified specifications, and with guarantee documents and user manuals, if any. 5.5 - For the delivery of the contracted product, the contract must be approved electronically, and the purchase price must be paid through the Buyer's preferred payment method. In the event that the product price is not paid or is canceled from the bank records for any reason, the Seller is considered relieved of their obligation to deliver the product. 5.6 - If the product price is not paid to the Seller by the bank or financial institution due to the unauthorized or illegal use of the Customer's credit card by an unauthorized person without any fault of the Buyer after the delivery of the product, the Buyer must inform the person or the delivered product that they are obliged to send it to the Seller in broad daylight. In this case, the Buyer bears the shipping costs. 5.7 - The Seller is obligated to notify the Buyer if they cannot deliver the product within the contract period due to force majeure or weather conditions, such as the interruption of air transport preventing transportation. In this case, the Buyer can use one of the cancellation orders, replace the contracted product with a previous one, and/or postpone the delivery period until the obstacle is removed. In case the Buyer cancels the order, the Seller must inquire with the relevant bank regarding the cancellation of the Buyer's credit card within 7 days and the relevant amount to be returned to the Buyer's account. In such a case, the Seller cannot be held responsible for the delay caused by the relevant bank. 5.8 - In case there is a defect or malfunction in the products delivered to the person and/or institutions requested by the Buyer for delivery, and to carry out the necessary repairs or adjustments within the warranty terms, the products or related products must be delivered to the Buyer within 7 days from the date of their receipt, and the Seller bears the shipping costs. In this case, if the 7-day period for waste products has passed, the Buyer must deliver the delivered product to the relevant service. 5.9 - This contract becomes effective if confirmed electronically by the Buyer (after completing the membership) ................................
Regarding Withdrawal (Right of Return): The Buyer has the right of withdrawal within seven (7) days from the date of delivery of the contracted product to them or to the person/entity they designate. To exercise the right of withdrawal, the Seller must be notified via fax or email within this period. The product must be unused and the packaging intact, in accordance with the provisions of Article 7. To exercise this right, the Seller must provide a document such as a shipment delivery report from the third shipment or a document proving the delivery of the product to the Seller. The Seller must apply to the relevant bank to refund the product price to the Buyer's credit card account within seven days of receiving these documents. The Seller is not responsible for any banking errors in the product price. In case the sales invoice is not sent, VAT or any other legal obligations will not be refunded. The ownership of the product returned under the right of withdrawal remains with the Buyer. The right of withdrawal does not apply to products that are inherently non-returnable, single-use products, reproducible software and programs, and damaged or expired products. The right of withdrawal for all types of software and programs, DVDs, VCDs, CDs, cassette tapes, computer supplies and stationery (such as ink, cartridges, ribbons, etc.), and all cosmetic products, is exercised only if the product's packaging is intact and unopened, undamaged, or unused.
Competent Court: In the implementation of this contract, the Consumer Arbitration Committees and Consumer Bodies affiliated with the Buyer or Seller are authorized by the Ministry of Industry and Trade. If the order is approved electronically, the Buyer is considered to have accepted all provisions of this contract.
